I-CERCA is subject to the provisions of Law 4/2008, of April 24, of the third book of the Civil Code of Catalonia, regarding legal persons; It is subject to the legislation of the Government of Catalonia and to the rest of the legal and regulatory norms that are applicable to this type of Foundation, and in a special way, to its by-laws.

Information on the Processing of Data for Parties Subject to the Agreement to Consolidate, Develop, Provide Continuity, and Regulate Actions Related to the Scientific and Technological Infrastructures of the CERCA System, as well as the Continued Development and Management of the CERCAGINYS Access Platform
1. Data Protection
1.1. Compliance with Data Protection Regulations
The parties commit to fulfilling all obligations arising from Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons regarding the processing of personal data and on the free movement of such data (hereinafter, GDPR); Organic Law 3/2018, of 5 December, on the protection of personal data and the guarantee of digital rights (hereinafter, LOPDGDD); as well as complementary legislation and any that may replace it regarding personal data protection for the application of this agreement. The parties also agree to collaborate with each other to ensure compliance.
In this regard, the liability framework for data processing arising from the execution of this agreement is established as follows:
1) I-CERCA is solely responsible for the personal data processing required to fulfil the obligations outlined in Clause 2.1 of this agreement.
2) Each CERCA centre that signs this agreement is solely responsible for the personal data processing they carry out to fulfil the obligations outlined in Clause 2.2 of this agreement.
3) ICERCA is solely responsible for the personal data processing required to fulfil the obligations outlined in Clause 12 of this agreement.
For the data processing operations indicated as 1), 2), and 3), each individual data controller must comply with all obligations imposed by the GDPR and LOPDGDD, including the duty to inform as set out in Articles 13 and 14 of the GDPR, the facilitation of individuals’ rights, and the implementation of appropriate security measures in accordance with the National Security Framework.
1.2. Data of Signatories and Contact Persons
The personal data of the signatories and contact persons collected under this agreement will be processed by each signing party, as data controllers, solely to enable the development, management, implementation, monitoring, and control of the agreement. The processing is legitimised as a task carried out in the public interest, in accordance with Article 6.1(e) of the GDPR. The identifying details of the signatories will be published in the register of collaboration and cooperation agreements.
The individuals whose data are processed have the right to access, rectify, erase, oppose, or restrict processing by submitting a written request to the data controller, whose contact details are provided in the header of the agreement.
If individuals believe their data is being processed in violation of data protection regulations, they may file a prior complaint with the data protection officer or a claim with the Catalan Data Protection Authority.
